Dragged node getting not included in drop-target node

The behaviour when drop a node to another one is not in any cases the same.
Sometimes the dropping node get's incorporated and sometimes not. Here a short capture of the different behaviour:

My expectation is, that the dragged node should be always added into the drop-target.
